From 8 to 10 October 2024, NHBC hosted this international meeting bringing together experts in home warranty insurance and housebuilding from around the world to share best practice, challenges and opportunities for new home warranty providers and compare approaches to the changing nature of homebuilding and wider innovations.

The agenda included discussions on global housing markets, economic outlooks, Insurance and reinsurance approaches, with external speakers presenting on the ten-year liability insurance around the world. Technical risk management and improving construction quality through data and NHBC’s training and consultancy approach, and climate change impacts and opportunities and how insurers can adapt in response to the physical and transition risks for housebuilding. A huge thank you to all participants at the IHHWA meeting for that fantastic contributions:

The IHA provides an international forum to address globally significant priority areas identified by member countries. The IHA often publishes Statements of Intent on these priorities, and shares information and solutions related to them through its working groups.

Current IHA priority areas include:

The IHA also provides economic and issue-specific information and insights to other global organizations with interest in housing, such as the World Bank and the International Monetary Fund, so these organizations have a more robust understanding of the many factors affecting housing and the housing industry around the world. In turn, IHA members benefit from the information and insights provided by these global organizations, which both strengthen members’ knowledge of global markets, and inform domestic policy recommendations and actions.

The IHA chairmanship is currently held by the Housing Industry Association (HIA) – Australia. The National Association of Home Builders (NAHB) serves as the secretariat. The purpose of AHWI is to build up the trust in housing insurers and their products and to have housing suppliers fulfill their defect warranty liability, which help protect consumers’ interests.

The activities of AHWI include a liaison role between the MLIT and the industry, consultation services, investigation of disputes between housing suppliers and insurance providers on the insurance payment and handling intention/gross negligence cases involving reinsurance companies when necessary. AHWI is also working on development of a judgment standard of intention/gross negligence cases

Gradually expanding its activities to include brokerage after the war, CEA specialised in the coverage of professional liabilities of engineers.

It took part in significant evolutions of construction insurance in France: the first work of reference on the Spinetta Law drafted by André ROUSSEL and associates (ed. technical), as well as the BTP professional reforms (contribution to preparatory works on the Law of 3rd January 1977 on architecture, and the Law of 19th December 1990 on the construction of individual houses which imposed the guarantee of delivery and outlined the related fees and timeframes).

The particularity of the French framework is that there are very specific legal obligations, especially concerning the risk of insolvency of a house provider (The 1990 law) and the risk of defects occurring within 10 years after completion (decennial liability and “Spinetta” law).

For house building AGEMI provides two sorts of warranties.

The first one, before completion, is called “Garantie de livraison à prix délai convenus” (Warranty for delivery at an agreed price and deadline) and covers the consumer against insolvency of the builder and gives to him a security of completion of his house on time and at the agreed price.

The second one, after completion, is decennial liability insurance and a “Dommage Ouvrage” insurance (First party building defects insurance). The “Dommage Ouvrage” is a pre-finance instrument intended to provide funds necessary for the repair of defects in the interest of the consumer.

AGEMI also provides “Dommage Ouvrage” insurance for flat building with the same cover as the house building one.

In South Africa, the warranty for subsidy and non-subsidy is compulsory. All new homes in the country should be enrolled with NHBRC at least 15 days prior to construction starting. It provides 3 different types of warranty.

In South Africa there is a key need to use alternative building technology solutions. Additionally, other challenges include building greener homes and focusing on sustainable human settlements.

A self-regulatory body, HomeBond is independent of Government and is a company limited by guarantee. The Board of the company consists of representatives of the residential sector. It offers homebuyers a ten-year warranty which incorporates a structural warranty and financial indemnities in the event of bankruptcy and liquidation.
Over 27 years HomeBond has registered in excess of 500,000 homes which means that approximately 40% of Ireland’s housing stock has benefited or is currently benefiting from HomeBond warranties.

New home warranties are voluntary in The Netherlands and consist of two types: Delivery and Quality. Not only new houses can be guaranteed, SWK also provides warranty certificates for rental houses, renovation and transformation projects and commercial real estate. In addition energy performance (EPG) certificates can be issued with a 10 year warranty. By 2021 all house construction in Europe should be energy neutral.
